Terms of Use

These terms apply when you use attachmatch.com.au (“AttachMatch”, “we”, “us”). By using the site, listing, enquiring or buying, you agree to them. Our Privacy Policy explains how we handle personal information.

1. What AttachMatch is

AttachMatch is an online marketplace that helps buyers and sellers of excavator attachments find each other. Sales are between the buyer and the seller. We are not the seller, buyer or agent, we do not inspect or hold the goods, and we do not guarantee any listing, user or transaction.

2. Using the site

• You must be at least 18 and able to enter a binding contract.
• Provide accurate information and keep your account and any edit or delete codes secure. You are responsible for activity under your account.
• Do not use the site for anything unlawful, misleading, harassing or abusive. Do not scrape the site, interfere with it, or try to get around its security.

3. Sellers

• You must own the attachment or be authorised to sell it. Stolen, counterfeit or unlawfully sold items are not allowed.
• Listings must be accurate and complete, including the type, pin diameter, ear spacing, pin spacing, width, condition, price, location and photos. Photos must be of the actual item.
• GST: tick “GST registered” only if you are registered for GST. If you do, the price you enter must include GST and your listing will say so. Otherwise it will show “No GST”. You are responsible for your own GST, income tax and invoicing.
• Keep listings current and mark them sold or delete them when the item is gone.
• You keep ownership of your photos and content. You give us a non-exclusive licence to display them on the site and in promoting your listing.
• If you use bulk import, you are responsible for the accuracy of the data and photos you upload.
• We may remove or edit any listing that breaks these terms, is misleading or is unsafe.

4. Buyers

• Check the details, confirm the attachment fits your machine, and inspect it before buying where you can.
• The fit-check and value-estimate tools are AI-assisted guides only. They are not advice or a guarantee of fit, condition or value.

5. Fees and payments

• It is free to list. A platform fee of 5% of the total (item price plus delivery) applies when a purchase is completed through Buy Now. The amount is shown at checkout.
• Payments and seller payouts are handled by Stripe, and Stripe’s terms apply. Sellers must connect a Stripe account to receive Buy Now payments.
• Prices are in the currency shown on the listing. Delivery or pickup is arranged between the buyer and seller as set out on the listing.

6. Messages and communications

Enquiries sent through the site are passed to the other party by email. We keep copies and may review them for support, safety, fraud prevention and resolving disputes, as described in the Privacy Policy. Do not send spam or share other people’s contact details.

7. Problems and disputes

Any problem with an item or sale is between the buyer and the seller. We may help where we can but are not required to. Nothing in these terms limits any rights you have under the Australian Consumer Law that cannot be excluded.

8. Our responsibility

The site is provided “as is”. To the extent the law allows, we are not responsible for the conduct of users, the quality, safety or legality of items, or losses arising from transactions between users, and we are not liable for indirect or consequential loss. Where the law does not allow us to exclude liability, our liability is limited, where permitted, to resupplying the service or the fees we received for the transaction concerned.

9. Suspension

We may suspend or remove accounts, listings or access if these terms are breached or to protect users or the site.

10. Changes

We may update these terms. Continuing to use the site after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
